Privacy Policy
Yadidi Shamir Association, ID 580020683 (hereinafter: “the association”) respects the privacy of the users of the website (here in after collectively: “the user” or “the users”) which it manages and operates at the address: https://shamirfriends.shamir.org ( Here in after: “the website”).
This privacy policy and the cookies policy (here after collectively: the “Privacy Policy”) regulate the way in which the association uses the information it collects on the website.
The information provided below is intended to help the user understand the association’s privacy policy on the website. The privacy policy, as will be detailed below, will clarify the information that the association collects about the users of the website, the purposes for which the association collects the information, what possible use the association may make of the information, who are the third parties to whom the association will transfer information and how the association handles and saves the information.
The information that the user provides to the association depends on the consent and desire of the user and does not result from a legal obligation. The information will be kept in the association’s database for the purposes specified in this privacy policy. The use of the website indicates the user’s agreement to this privacy policy and that information will be stored and managed in the aforementioned database. The information in the database will be used in accordance with the provisions of this privacy policy or according to the provisions of any law, for the purposes listed below.
This privacy policy is written in the masculine language only for convenience and should be seen as referring to the feminine language as well.
What is information?
In this policy, the term “information” means all information collected by the association or provided to it by the user or someone on his behalf, as part of the user’s use of the website, through which the user can be identified and information protected according to the Privacy Protection Law, 1981-1981 ( Hereinafter: “The Law”).
The sources through which the association collects information about the user
through use of the website;
When the user requests to join the association’s mailing list (newsletter);
through a donation on the website.
The information that the association collects about the user
The association will collect about the users the information detailed below (in whole or in part):
full name;
phone;
mobile phone;
date of birth;
email;
address;
Last four digits of the payment method through which the website user donated to the association;
The content of the message that the user sends to the association;
Any additional information that the user submits and/or is received by the association in connection with the user and the use of the website;
In addition, during the use of the website, the association will collect non-identifying information about the users, which does not reveal the personal identity of the users, as detailed in the cookie policy in section 10 below (hereinafter: “non-identifying information”).
Why does the association collect the information and the use that the association makes of the information (the “purposes”)?
The association collects information about the user for the following purposes – all or some of them:
operation and management of the site including marketing, advertising, and encouraging donations;
in order to allow the user to carry out the actions through the site;
for the development and operation of the site;
for the maintenance of the website and monitoring its user activity;
to contact the user;
for compiling statistical data and transferring information, including statistical or other, to third parties;
for analysis, and research and compilation of statistics;
to conduct surveys among users;
for direct mail purposes as defined by law;
for the association’s internal needs;
To defend against lawsuits, demands and claims against the association and those on its behalf as well as against third parties;
To enforce the provisions of the terms of use and this privacy policy;
in order to comply with the provisions of any law;
Also, the association makes use of non-identifying information collected by various technological means, among other things, for the purpose of operating the website, in order to facilitate the use of the website, for statistical tests in connection with the use of the website and more, as specified in section 10 of the privacy policy below.
Transfer of information
The association will not transfer or give information to third parties except as specified in the privacy protection policy.
The transfer of information to third parties will include only relevant information that does not exceed the purposes for which the information is transferred and will be carried out proportionately for a specified, explicit and legitimate purpose.
The association may transfer the information or any part of it to third parties in one or more of the following cases:
Third parties who provide the association with various services, including support services for security systems and information technology (IT) systems, information storage services, clearing services, website building services, survey and research services, companies that provide advertising and marketing services, lawyers or other external professional consultants and other third parties who provide the association with services in connection with its activities.
If the association receives an instruction, including a judicial order ordering it to provide the user’s details or information about the user in accordance with the provisions of any law.
In any dispute, claim, demand, claim or any legal proceedings between the user or anyone on his behalf and the association or anyone on its behalf.
In the case of a merger of the association and/or its activities with third parties, among other cases in which the ownership of the website and/or its contents, all or part, will be transferred to third parties, and without prejudice to the generality of the said, in cases of a change of control, full or partial, in the association.
If a claim is raised or the association suspects that a user has committed an act and/or omission that may harm the association, on its behalf, any third parties, including other users.
If a claim is raised or the association suspects that a user is using the website for the purpose of committing an illegal act and/or to enable, facilitate, assist and/or encourage the commission of such an act.
In any case that the association believes that the provision of the information is required to prevent damage to the association, the user or any third party.
The association may transfer the information to third parties, as stated above, also outside the State of Israel, including to third parties who are located in countries where the level of protection of the information is different from the provisions of Israeli law and which may provide less protection than that provided according to the privacy protection laws in Israel. Without deviating from the provisions of this policy, use of the website indicates the user’s consent to this privacy protection policy, including the transfer of information, its preservation and storage by third parties located outside the State of Israel.
In addition, we note that the credit card details of the user who donates on the site are linked within a frame (IFRAME) directly to the clearing companies CardCom and BA (hereinafter: the “clearing companies”) for the purpose of making the donation to the association. It will be clarified that the association is not a party to this. The user is responsible for checking the privacy policy on the websites of the clearing companies at: https://www.cardcom.solutions/, _https://www.shva.co.il/ respectively before making the donation. The user will use the clearing page on the website only after everything stated in the privacy policy of the clearing companies is accepted and agreed upon. Also and without deviating from the provisions of this privacy policy, the user confirms and agrees that the association will not be responsible for any damage of any kind, indirect or direct, caused to the user and/or to those on behalf of the user in relation to the retention, storage and processing of the information by the clearing companies, including but not limited to Only in cases where the information is lost, disclosed or if any unauthorized use is made of it.
Without deviating from the provisions of this privacy policy, the association and anyone on its behalf will not bear any liability, and is exempt from any liability, in connection with any damage, loss or expense, of any kind and type, whether direct or indirect and/or circumstantial and/or consequential, which were caused and/or will be caused to users and/or to a third party, in all that is related to and concerning service providers, including in all that is related to the collection of information by service providers, its use, its transfer to third parties, its preservation and security by service providers, and more.
Information security
The association takes technical and physical measures regarding privacy and information security in accordance with accepted standards. As we know, the storage and transmission of information by electronic means, including via the Internet, can never be completely safe, and at any time when the user submits information to the association, in particular via the Internet, the user does so with full consent and subject to the dangers involved in the transmission of information in this way.
The association does not guarantee that the website will be completely immune from unauthorized access to the information stored on it. In any case, if the user has reason to believe that the transfer of the information to the association is no longer safe, please inform us by contacting us in section 15 of the privacy policy.
Limitation of liability
The association and anyone on its behalf will not bear any liability, and it is exempt from any responsibility, in connection with any damage, loss or expense, of any kind and type, whether direct or indirect and/or circumstantial and/or consequential, which have been and/or will be caused to users and/or to a third party, in everything related to the collection of the information, its use, its transfer to third parties, its preservation and security.
Information retention period
The association will keep the information about the user for the period of time necessary to ensure the goals detailed in this privacy policy unless a longer retention period is required or permitted by law.
Information about other people
If the user provides personal information to the association regarding other people, including his family members and other third parties, the user must do so only after: (a) the user has informed the third parties about the content of this policy; and – (b) the user received the required consent for the collection, use, disclosure and transfer of personal information about the third party in accordance with this policy and in accordance with the provisions of the law, as required.
Cookies
The site may use cookies and other technologies for one or more of the purposes listed in this privacy policy.To the extent that the site uses cookies, you can refer to the Cookies Policy (hereinafter: “Cookies Policy”) for more information about how cookies and technologies are used on the site.
The right to review and correct the information
The right to review and correct the personal information is in accordance with the provisions of the law. If the user wishes to review or correct the information, this can be done by contacting the association in accordance with the contact details that appear in section 15 of this privacy policy below.
Applicable law and jurisdiction
The conditions and instructions detailed in the privacy policy, as well as any change or amendment thereof, as well as the use of the website, will be regulated according to the laws of the State of Israel without reference to the applicable choice of law clauses therein.
Jurisdiction in connection with any dispute and/or claim that may arise in connection with the use of the website and this privacy policy or related to it, is exclusively given to the courts of Tel Aviv-Yafo.
Changes and updates
The association may, at its sole discretion, change the privacy policy from time to time and this without the need to provide a notice or notification thereof.The latest privacy policy published on the website will bind the user. The user’s continued use of the website after the privacy policy has been updated will constitute the user’s acceptance of the updated privacy policy, including changes.
Variance
The user may not transfer his rights and/or obligations according to this privacy policy to another. The association may transfer its rights and/or obligations to another.
This privacy policy does not derogate from any right granted to the association and/or anyone on its behalf under any law.
